__________________________________ The images used in my wallpapers and other graphics belong to Showtime, CowLip Productions, Fox Home Entertainment, Chris Carter, Focus Features, TLA Releasing, C. Jay Cox, etc. etc. In other words, not me. HOWEVER, I consider the designs I make with those images to be my intellectual property. I put a great deal of myself in to each piece of artwork, and having it used in a manner I never intended or expected feels like a personal violation - it hurts. I've always loved sharing them with like-minded fans, but it's very frustrating and disappointing to find out how many people there are in this world who know nothing of common courtesy and respect. The following mainly applies to using celebrity images for profit. It is worth noting that anything being sold using the likeness of a music, television or movie personality - or of anyone without their consent - is against the law, and against eBay's policies. http://pages.ebay.com/help/community/png-faces.html You will never see any of my artwork that uses images of celebrities for sale by me, nor will I ever authorize anyone else to sell them, because it is against the law. I do not have permission from the copyright holders of those images to make a profit off them. Copyright and intellectual property right laws are confusing and complicated, but this concept should be easy enough for even the most clueless person to understand: It's against the law to make a profit off of something that doesn't belong to you. And be very careful about what you assume belongs to you. I strongly recommend reading this: http://www.whatiscopyright.org/ In addition, Cafe Press has a very well written and easy to understand section on this subject: http://www.cafepress.com/cp/info/help/law.aspx and http://www.cafepress.com/cp/info/help/parodylaw.aspx The following is quoted from the latter page: = California's right of publicity statute provides: Any person who knowingly uses another's name, voice, signature, photograph, or likeness, in any manner, on or in products, merchandise, or goods, or for purposes of advertising or selling, or soliciting purchases of, products, merchandise, goods, or services, without such person's prior consent . . . shall be liable for any damages sustained by the person or persons injured . . . . Cal. Civil Code § 3344(a) (West 1999). Under this provision, one may not knowingly use the photograph of another for commercial use without the permission of the subject, regardless of who owns the photograph. The same rules apply for using the name, voice, signature or likeness of another. The statute provides an exception for using another's name, voice, etc. for news, public affairs, sports broadcasts or political campaigns. See id. § 3344(d). = |
